STATUTE OF LiMiTATiONs

Have you heard of Charles Sobhraj?

He is a very famous (infamous?) man in India many years ago=about 20 years ago – give or take few years. His name is Charles Sobhraj. He is son of a Sindhi (Hindu) father and Vietnamese (=Hindu/Buddhist) mother. He is probably French citizen and carries a France passport.

He is (was?) accused of murder in Thigh Land (Thailand?) many years ago. He ran away from Thigh Land and came to India. In time he committed some crime in India. He was arrested, tried, and sentenced to long time in prison.

Just before completing his sentence in Tihar jail in Delhi, he broke out of Tihar Jail and ran away to Goa.

Why did Charles Sobhraj break out of jail just a month before he was to be released and would be a free man? If he could spend many years in jail, could he not wait just one more month and be a legally free man in India?

Yes, he could be a free man in India but not in Thigh Land. After completing his Jail term in India he would be free in India, but as per international law he would have to be re-arrested by Indian Police and sent to Thigh Land to face trial there for murder. But if he commits any crime in India he must serve time in India (even pickpocket – for which the sentence may be just three months), he must serve his time in Indian Jail before being sent to Thigh Land.

Under Thigh Land Law, there is a STATUTE OF LiMiTATiONs, which means that after you have committed a crime, you MUST be arrested, and face trial WiTHiN a certain period of time: For pick-pocketing it might be three months, for robbery it might be five years, for armed robbery it might be seven years, for attempted murder it might be ten years……..and so on, something like that.

What I am 100% sure about is that the STATUTE OF LiMiTATiON for MURDER in Thigh Land is TWENTY YEARS. Charles Sobhraj also knew this. He was accused of Murder in Thigh Land, and before he could be arrested he ran away and came to India.

However, as per international law and protocol, Indian police must arrest him and send him to Thigh Land to face trial. Knowing this, Charles Sobhraj committed crime in India, was tried, found guilty and jailed in India. By now, Charles Sobhraj had spent some 18 years outside Thigh Land and he was about to complete his jail term in Tihar Jail in Delhi, India, after which the Indian police MUST send him to Thigh Land to face trial for murder.

It is reportedly believed that Charles Sobhraj engineered his escape from Tihar Jail (apparently with the connivance of the authorities) and went to Goa.

After spending some time in beautiful Goa, on a particular day (people say it was planned) Charles Sobhraj was sitting in Goa’s most famous restaurant named “O’COQUEIRO”, less than half km north of Mandovi bridge. This happened in 1986. O’COQUEIRO has now been taken over by the Taj group. I have been in O’COQUEIRO many years ago (before being taken over by Taj) and know the place very well. It serves the BEST PRAWNs IN THE WORLD! O’COQUEIRO IS FANTASTiC!

Inspector Madhukar Zende walked into O’Coqueir0 where Sobhraj was eating prawns. As he stopped at the table, Charles Sobhraj looked up and said, “Inspector Zende I presume?”

“Charles Sobhraj I presume”, replied inspector Zende, and arrested him on a charge of jailbeak. Charles Sobhraj was tried for jailbreak, convicted, and sent to Jail. This was in 1986.

By the time Charles Sobhraj completed the jail sentence in India, more than 20 years had passed since the murder he was accused of in Thigh Land. The STATUTE OF LiMiTATiONs kicked in, and Charles Sobhraj could now officially and openly go back to Thigh Land as a FREE MAN.

That is The Statute of Limitation.

Does India have a Statute of Limitation for any crime? I am not sure, but I don’t think so.
